Website "website" – a service for ordering passenger transport services and concluding passenger transport contracts,
by users and enables online payments.
Passenger – a person or persons using the passenger transport service together with luggage and accepting the following regulations and is a person representing the party ordering the service who has concluded a passenger transport agreement.
Driver – a licensed taxi driver or other driver with appropriate qualifications to drive a vehicle that is a taxi or bus and may perform transportation under a separate cooperation agreement.
Mandatory – The company WarsawBusTravel.pl is the entity accepting the order for execution and assigning it to the driver responsible for the proper performance of the service.
Passenger transportation service – transport service provided to Passengers by Drivers using a taxi (within the meaning of Art. 2
point 43 of the Act of 20 June 1997 - Road Traffic Law, Journal of Laws of 2005, No. 108, item 908, as amended, in connection with Art. 4 sec.
1Act of 6 September 2001 on road transport, Journal of Laws 2007, No. 125, item 874) or vehicles with more than 9 persons
in accordance with applicable law (Occasional transport – carriage of persons which does not constitute regular carriage, carriage
regular special or shuttle transport;

§1
General comments regarding services offered by WarsawBusTravel.pl Sp. z o.o.
In accordance with the following regulations, the Passenger who uses the WarsawBusTravel.pl website orders a passenger transport service by filling out the form and clicking the "ORDER" button or by phone at +48510230710, and thus expresses the will to conclude a contract for the transport of people with the Contractor. Information, including the Passenger's data, is transferred to the Driver, who confirms the will to perform the service by confirming the order via e-mail in a return response or by phone. The Passenger can also connect at any time with the person coordinating the transport at +48510230710 and obtain information on contact with the driver performing the transport. The Driver entrusted with the performance of the transport, in order to perform the contract, is obliged to appear at the location indicated by the Passenger, provided that it allows a safe and compliant with road traffic regulations place of stopping. The passenger transport agreement is concluded by submitting declarations of intent: Passenger after pressing the "Send Order" button, confirmation via e-mail or telephone, by which he confirms the order for the service and at the same time accepts all the conditions of transport previously agreed.
§2
Fees and payments
- WarsawBusTravel.pl does not charge the Passenger any fees for ordering a journey and not using the service in the event of cancellation of the service with an appropriate advance notice, i.e. if the transport service has not been ordered for performance.
- In the case of a special reservation, i.e. ordering a selected: vehicle, colour, brand, unmarked "TAXI" or availability for a longer period, a reservation fee of 50% of the order value will be charged.
- The fee will not be charged in the event of a change in the order completion date, but only when the contractor confirms the possibility of completing the order.
- Based on the concluded passenger transport agreement between the Passenger and the service recipient, the service is settled based on arrangements made via e-mail or telephone.
- Payment methods are as follows: online payment (before the course), prepaid transfer, cash before or immediately after the transport and payment card, credit or debit after prior arrangement with the operator. The possibility of transfer based on an invoice can be used by entities previously cooperating.
- WarsawBusTravel.pl may introduce a different form of settlement with the service ordering party. In the case of long-term orders requiring high involvement of rolling stock and employees.
- The passenger may demand reimbursement of the difference in costs incurred in the event of failure to complete the order on the specified date on the specified route and with the specified number of people using transport similar to that ordered if the reason lies with the service recipient and there were no so-called force majeure events.
Withdrawal from the service contract
1. In accordance with the Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended), a consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving a reason and without incurring costs, for contracts concluded 21 days or more before the service is provided. Withdrawal from the contract without giving a reason may occur no later than 7 days before the order is provided. To meet the deadline, it is sufficient to send the relevant information electronically to contact@warsawbustravel.pl, as well as by phone at +48 510230710; for this purpose, please prepare information on when and from where the service was to start.
2. If the Ordering Party has paid an advance or made the entire payment for the future service and has exercised the right to withdraw from the service agreement. The refund of the amount paid by the Ordering Party will be made using the same payment channel or by transfer to the bank account number indicated by the Ordering Party, which should be sent electronically to the address contact@warsawbustravel.pl or by SMS to the number +48510230710
Complaints
1.The provisions of this section apply to the concluded transport service agreement concluded in writing and do not provide for detailed procedures for reporting and considering complaints.
2. The User or the Ordering Party may file a complaint if the service was performed contrary to the arrangements or was not performed properly by WarsawBusTravel.pl sp. z o.o.
3. Complaints regarding the method and quality of service provision must be reported by the User or the Ordering Party to WarsawBusTravel.pl in the following manner:

4. A properly filed complaint should contain at least the data of the User or Ordering Party filing the complaint (name, surname, address of residence, date of service provision, from where and to where) and should indicate any irregularities in the service provided.
5. The subject of the complaint and its validity are assessed by the company's management board or an authorized representative of WarsawBusTravel.pl within 14 days from the date of receipt of the complaint.
6. If the complaint is justified, after analysis with the User. The amount of compensation will be determined in the form of money up to the value of the order or a discount on subsequent services.
7. WarsawBusTravel.pl is obliged to implement the agreed compensation within the time limit agreed with the User or the Ordering Party, but no later than 1 year.
8. A complaint may be deemed unjustified if the irregularities in the performance of the service occurred not due to the fault of WarsawBusTravel.pl or random causes.
§3
General rights and obligations of the Passenger
- Before starting to use the services of the WarsawBusTravel.pl portal, the passenger is obliged to read the regulations located on the website www.WarsawBusTravel.pl. When ordering, the ordering party is required to provide true personal data of the Passenger or the ordering party (Name, Surname, telephone number or e-mail) and provide direct contact to the passenger responsible for coordinating the transport. Ordering Transport is tantamount to accepting the regulations and expressing consent to the processing of personal data of the Passenger or the ordering party provided in the ordering process
- The Passenger is obliged to provide complete and truthful personal or company data required by WarsawBusTravel.pl and to check and update them without any requests from WarsawBusTravel.pl.
- The passenger is obliged to use transport in accordance with its intended purpose and in accordance with the law and principles generally accepted as applicable.
§4
Responsibility of WarsawBusTravel.pl
- WarsawBusTravel.pl is not responsible for the authenticity, correctness and completeness of the data that is transferred via the website between the Passenger and the Contractor. WarsawBusTravel.pl is also not responsible for the data being received in due time (both by the Passenger and the Contractor).
- WarsawBusTravel.pl is not responsible for the loss of data related to the order in the devices and correspondence on the part of the Ordering Party. Securing this data is the responsibility of the Ordering Party.
- WarsawBusTravel.pl is not responsible for the content and links to websites belonging to third parties and posted on the website. www.WarsawBusTravel.pl without the knowledge of the site owner.
§5
Personal data protection
- All personal data provided by the Passenger using the order panel (name, surname, e-mail address, telephone number and location) will be stored and processed in accordance with the provisions of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws 2002, No. 101, item 926, consolidated text, as amended).
- All personal data of the Passenger collected by WarsawBusTravel.pl are stored and processed in a manner necessary for the proper execution of the order.
- Starting the order fulfillment process means accepting all points of the regulations below, along with expressing consent to the collection, storage and processing of the Passenger's personal data, as well as expressing consent to the disclosure and transfer of data in the form of name and surname, phone number and location to individual Drivers fulfilling the order, who agree to provide the service of transporting passengers. The Passenger may at any time, in writing, withdraw his consent to the use and processing of his personal data, which will be tantamount to closing the order fulfillment process.
- The Passenger agrees to the collection and use of his/her personal data for settlement purposes. This data is necessary for the proper functioning of the website and is used solely for the purpose of proper settlement of contracts concluded by WarsawBusTravel.pl. The collected data is of identification nature and contains information on the telecommunications media used and the start and end times as well as the general time of using the order (use of means of transport).
- The Passenger consents to the disclosure of his/her personal data for purposes related to the fulfillment of the principles of these regulations of the WarsawBusTravel.pl website or the pursuit of legal claims related to the implementation of these regulations.
- Consent to the storage and processing of data is voluntary.
- The passenger has the right to view and correct his or her data.
- Please send any information on the use of personal data, as well as access to their content, how to update or withdraw consent to their use via the contact form located on the website www.WarsawBusTravel.pl or in writing to the current address indicated on this website.
§6
User Rating System
- The Passenger is entitled to a fair assessment of the services provided by the Drivers, both the Driver himself and the vehicle. The Passenger undertakes to provide only true information.
- The Passenger consents to the publication of ratings in the TripAdvisor.com application and on the website www.WarsawBusTravel.pl.
§7
Final provisions
- If any provision of these regulations (or part of any provision) is found by a court or other competent authority to be invalid, unenforceable or illegal, the remaining provisions will remain in force and will be considered binding and binding. The provision found to be invalid, unenforceable or illegal will be replaced by another provision that best corresponds to the economic and commercial purpose of using the order form
- WarsawBusTravel.pl reserves the right to change the content of the regulations. The new Regulations are effective from the date of placing the new version on the website www.WarsawBusTravel.pl
- The passenger has the right to submit written objections and complaints to the changes introduced in the regulations within 7 days of their publication. Submitting an objection will automatically result in the termination of the rights to use the ordering panel.
- The law applicable to these regulations will be Polish law.
General terms and conditions of service
„Mobile payments”
Definitions
By agreeing to the terms below, the Passenger accepts that WarsawBusTravel.pl Sp. z o.o. will charge the Passenger's debit card or bank account (e.g. credit card, Pay Pal account, electronic payment order or other payment option) indicated by him/her in the order panel during the payment process for the passenger transportation service for the amount confirmed by the Passenger.
The user has the option of enabling the automatic collection of funds for the provision of a service using the default payment method, without having to confirm the transaction amount each time.
The following terms and conditions apply in conjunction with the Terms and Conditions of Use upon confirmation of the Passenger’s order.
§1
Subject of the service
- WarsawBusTravel.pl offers the possibility of cashless payment, up to the amount specified by WarsawBusTravel.pl, for the passenger transport service ordered via the order panel or by phone confirmed electronically. The fee is collected from the User via electronic payment order, credit cards or mobile payment systems.
- When registering for the mobile payment service, the Passenger has the option to select their preferred cashless payment method, which may be changed or deleted at any time, outside the duration of the journey.
- In the case of payment via PayPal, the User will pay the amount confirmed during the payment process without disclosing their PayPal account to the transport service provider. According to the PayPal terms of use, the Passenger is required to set up a PayPal account and may be charged an additional fee for using this service. PayPal reserves the right to charge the User's PayPal account in different amounts during the payment process.
§2
Passenger Obligations
- The Passenger has full freedom in choosing the method of payment. Payment can be made in cash or by card to the Driver or one of the non-cash methods in accordance with §1 paragraph 1.
- In the case of non-cash payment, the gross amount is assumed to be paid.
- The User is obliged not to make their WarsawBusTravel.pl account available to unauthorized persons. In the event of loss of the device on which the User uses the Pay Pal application and mobile payment services, or any other unauthorized use of the account by third parties, the Passenger is obliged to notify WarsawBusTravel.pl in writing to the address ul. Paprotki 6 05-830 Rusiec, electronically to the address contact@warsawbustravel.pl
- In the case of non-cash payment for the ride, payment confirmations will be sent electronically to the Passenger's email address, which was provided during the order. At the User's request, an invoice may be sent to the Passenger's email address or to the correspondence address, which will be forwarded to the contractor at contact@warsawbustravel.pl or by traditional mail
- WarsawBusTravel.pl reserves the right to exclude cashless payments in individual cases without giving a reason.
§3
Duration of validity
- The general terms and conditions of payment within the "Mobile Payments" service are valid for an indefinite period of time from the moment of their acceptance by the User.
- It is possible for both parties to resign from the mobile payment service at any time without giving a reason. The required form of notification of resignation from the service is a written form via e-mail to the address contact@warsawbustravel.pl
§4
Payment Policy
- The Passenger undertakes to ensure sufficient funds in the account used for mobile payments. In the event of insufficient funds in the account at the time of non-cash payment resulting in an unsuccessful attempt to debit the account of the Passenger or the Client, WarsawBusTravel.pl reserves the right to enforce the due fees and costs in another form, e.g. bank transfer or cash settlement directly with the travel service provider.
- WarsawBusTravel.pl is not responsible for the process of cashless payments, including the process of charging a credit card or PayPal account. In the event of errors regarding charges, calculation errors or payment system failures, the Passenger is obliged to contact the payment service provider or the issuer of the payment instrument directly.
- WarsawBusTravel.pl reserves the right to charge interest for late payment by the Passenger in the amount of up to 5 percentage points above the NBP reference rate, together with a handling fee of PLN 50 (in words: fifty zloty).
- In the event of damage caused by the use of an account that has been previously reported by the User for blocking, WarsawBusTravel.pl undertakes to cover the costs of the damage.
§5
Final provisions
- WarsawBusTravel.pl reserves the right to change these terms and conditions as part of the "Mobile Payments" service by notifying about the changes on the website www.WarsawBusTravel.pl. The current terms and conditions of the "Mobile Payments" service are available on the main website www.WarsawBusTravel.pl
- After receiving information about the change in the terms and conditions of the "Mobile Payments" service, the Passenger may not consent to further use of the service, which results in the termination of the Passenger's rights to use the cashless payment option in the ordering panel.
- If a competent court or other authorized body finds any of the above-mentioned points of the regulations to be invalid, voidable, without legal force, non-binding or unenforceable, it is assumed that the remaining parts will continue to be binding and applicable.
- The court with jurisdiction to resolve any disputes is the court with jurisdiction over the seat of WarsawBusTravel.pl.
